Can I be prosecuted in Teaneck, NJ, for DUI/DWI/Drunk Driving if the Alcotest results fail or are inadmissible due to technical or other reasons?
The answer in Teaneck, New Jersey is a clear yes. This is called an observation case as it will be based solely on the observations and opinions of the arresting officers. What few defendants know is that most DUI/DWI/Drunk Driving arrests occur with a video running and that all of their movements, statements and actions are being recorded. The video is generally located on the dashboard of the police car that responds to the scene and can be aimed at the DUI/DWI/Drunk Driving suspect, whether he or she is on a sidewalk performing preliminary physical tests, or sitting in the back seat of the patrol car after an arrest. This video becomes part of a Teaneck prosecutors arsenal in an observation case.

Do I have the right to refuse to take a DUI/DWI/Drunk Driving BREATH TEST, and what happens if I do refuse?
The answer in New Jersey is NO, you have no right to refuse to take the breath test. Whether you know it or not, New Jersey law provides that any person who operates a motor vehicle on any public road, street or highway or quasi-public area in this State is deemed to have given his consent to the taking of samples of his breath for an Alcotest or Breathalyzer test. Refusing the breath test carries serious penalties which generally parallel and are in addition to the penalties for DUI DWI Drunk Driving. Refusing or refusal of the breath test is a serious complication to a DUI DWI Drunk Driving arrest as the refusal can seriously increase the level of penalty. Even so, there are defenses in Refusing and Refusal cases in which the lawyers at Avery & Avery, Esqs., are highly experienced, enabling them to be of considerable help those charged with Refusing or Refusal of the Breath Test, and in minimizing the penalties for refusal. Teaneck, NJ, general information:
Teaneck was created on February 19, 1895 by an Act of the New Jersey Legislature. Teaneck was formed from portions of Englewood Township and Ridgefield Township, both of which are now defunct (despite existing municipalities with similar names), along with portions of Bogota and Leonia.[18] Independence followed the result of a referendum held on January 14, 1895, in which voters favored incorporation by a 46–7 margin.[19] To assuage the concerns of Englewood Township's leaders, the new municipality was formed as a township, rather than succumbing to the borough craze sweeping across Bergen County at the time.[19] On May 3, 1921, and June 1, 1926, portions of what had been Teaneck were transferred to Overpeck Township.[20]
Teaneck lies at the junction of Interstate 95 and the eastern terminus of Interstate 80.[21] It is bisected into north and south portions by Route 4 and east and west by the CSX Transportation River Subdivision. Commercial development is concentrated in four main shopping areas, on Cedar Lane, Teaneck Road, DeGraw Avenue, West Englewood Ave. and Queen Anne Road, more commonly known as "The Plaza".[22]
Teaneck's location at the crossroads of river, road, train and other geographical features has made it a site of many momentous events across the centuries. After the American defeat at the Battle of Fort Washington, George Washington and the troops of the Continental Army retreated across New Jersey from the British Army, traveling through Teaneck and crossing the Hackensack River at New Bridge Landing, which has since been turned into a state park and historic site commemorating the events of 1776 and of early colonial life. In 1965, Teaneck became the first community in the nation with a white majority to voluntarily desegregate its public schools, after the Board of Education approved the plan by a 7–2 vote on May 13, 1964.[23][24] Teaneck has a diverse population, with large Jewish and African American communities, and growing numbers of Hispanic and Asian residents.[25]
